Geez, this is the second image compliment I'm passing out today (what's wrong with me?)... Your ChronChron image is really great stuff -- lots of attention to detail and expertly crafted. I'm sure there must be too much going on in it to be featured, but I love it just the same. That needs to be displayed somewhere prominent, like a museum or Parliament. 'cos you're active in wikipedia and 'cos wikipedia overwhelms me and 'cos their pump is apathetic and 'cos Nv8200p looks fearsome, i was wondering if you could tell me:

  • if this image in this site is actually under copyright? the fine print in the site says, "Copyright © 1996-2003" - isn't that "past" plus would that automatically include imgs if the site is still under copyright?
  • i've tried enquiring about its status from the site owners by email but all my mails have gone unanswered for frankly they couldn't care less.
  • Nv8200p has deleted my uploading twice and he's pissed off - i can sense it.
  • if i digitally alter it (say make it say "charcoal" in photoshop), will he still delete it?
  • i want to (desperately) add the image to this page.

Obviously, I am not a lawyer an all that, so this is just my understanding:
Copyright does not depend on a copyright notice. So an image is copyright on the photographer (not the owner) or his employer (in some circumstances) whether or not it is marked as copyright. The exceptions are images that have been specifically released from copyright, or very old images that are no longer regarded as copyright. There's no reason to think that this one is either.
"Fair use" may apply, but in this case I doubt it. The reason we can get away with that on Uncyclopedia (probably/maybe/we'll find out in court) is that the work is done for reasons of parody - something specifically protected in the fair use conditions.
Changing the work does not change the copyright status. The images becomes a "derivative work" and is copyright of the original photographer and the new artist. However, unless the new artist has permission for the new work, it is a violation of the copyrights of the original photographer. So the fact that he holds, in part, copyright to the derivative actually means nothing - it's still illegal.

so like you can merrily reproduce text (long passages - the crux of the book minus the chaff), with impunity, as long as you cite your source but you can't reproduce b&w photos today? everything regresses to a digital signature in today's age - then why this bias? reprints and imitations are made and distributed freely in the print world. obviously something jars when it's taken to mean for all media. i think "images" are caught in the in-between of this fight between print and other medias. i suppose one would have expected the leniency extended in times bygone to reproductions of portions of text and duplication of images for illustration -- provided the source was duly acknowledged, to have persisted in the laws of today? it's actually a subject for philosophers of law and we will have to wait for their verdict (the corporate-nation-states would love to sponsor the deliberations of these jobless philosophers, of course). just rambling (i do that often). -- mowgli 17:28, 2 September 2006 (UTC)
Text is subject to the same restrictions. You can paraphrase, and possibly quote a small section as "fair use", but a large reproduction is a copyright violation, as is a slightly altered derivative. Of course, what is a derivative and what isn't is a matter for the courts... it's a complex area with a lot of variation. You can't copyright facts, but you can copyright the format those facts are in. Fiction has it's own set of variations, and parody comes into it again. you could try either sannse@tiscali.co.uk or sannse@gmail.com - I think the gmail will work

I was looking at the user rights log, and although it is none of my business, why did you take sysop and staff right away from those users that you did? The staff was an addition now a removal, it had been missed when KJ joined Wikia. Most of the others were by community request because they had been inactive for a very long time (see some forum thread or other).
